Indonesia challenges EU over duties at WTO

GENEVA (Reuters) - Indonesia went to the World Trade Organization on Monday to overturn anti-dumping duties imposed by the European Union in its first such complaint against the bloc since winning a WTO court challenge against the United States.

Indonesia wants to overturn EU anti-dumping duties on imports of Indonesian fatty alcohols, which are used in the chemicals industry, the WTO said. Such duties are imposed when a country thinks imports are priced at an unfair discount.

By demanding "consultations" with the EU, Indonesia has triggered the first stage in a trade dispute, which may escalate into an adjudication battle if not resolved within 60 days.

The case is the latest in a series of challenges in which big developing economies are hitting back at assertions that their exports are unfairly priced or subsidized. India, China and Brazil have all initiated disputes in the past four months.

Indonesia's last involvement in litigation ended in April when it won an appeal against a U.S. ban on the sale of clove-flavored cigarettes, most of which come from Indonesia, as well as other flavors such as cherry and cinnamon.

The U.S. law, which was intended to stop children smoking, was found to be discriminatory because it did not also target menthol cigarettes.

Indonesia has not been on the receiving end of trade litigation since 1996, the year after the WTO was created. But its own trade practices have come increasingly under fire, with the United States blaming it this year for putting up barriers to imports and Japan angry at its curbs on metals exports.

Both those countries, and the EU, have also raised questions in WTO committee meetings about Indonesia's "local content" rules for investments in telecoms and the energy sector, which they say unfairly discriminate against foreign firms.

Such questions sometimes escalate into trade disputes if not resolved by the answers raised in committee sessions, and if the complainants feel the WTO litigation system gives them a good chance of winning the dispute.

(AP) ? Mitt Romney says that if he paid more taxes than were required, he wouldn't be qualified to be president.

The U.S. presidential candidate tells ABC News that American voters expect candidates to pay "only what the tax code requires." He says he hasn't calculated what percentage of his income was paid in taxes but says that he's been audited.

Romney's vast personal wealth has been an issue in the campaign.

Democrats have criticized him for paying only 13.9 percent of his income in taxes during the one year his taxes have been made public.

Romney says he will release an additional year of returns before Election Day. That has left some questioning whether Romney pays a smaller share than other Americans.

Afghan truckers a forgotten front in a war growing deadlier by the day

KHOSH GOMBAT, Afghanistan (Reuters) - In the cabins of their "jingle" trucks flamboyant with tinsel baubles and painted tiger patterns as they move NATO's war supplies, Habibullah thinks he and other drivers are becoming a forgotten front in an Afghan war growing more vicious.

From a dusty truck park midway between Kabul and the Pakistan border, and under the constant thump of helicopters from Jalalabad airbase over the road, Habibullah moves food and military materiel across the Taliban's eastern heartland, from Nuristan to the former al Qaeda cave stronghold of Tora Bora.

"We worry about our fate when NATO leaves, because the Taliban also call us the infidels. For them, we are not just the enemy, but also traitors," said the soft spoken 23-year-old, who contributes seven trucks to a cooperative with five owners.

It is a thankless and increasingly deadly job, and one so mired in graft that the drivers see a fraction of the cash paid by U.S. military paymasters, with the rest skimmed by middlemen or even going into the hands of insurgents for "protection".

Only this week, three of Habibullah's trucks were attacked and burned by Taliban amid the rugged mountains of Nuristan, a virtual no-go zone for NATO soldiers after heavy past losses and now garrisoned by a handful of Afghan troops and police.

A truck belonging to another company was torched and the driver shot dead across the border in Pakistan, while 22 fuel tankers were blown up in the north by insurgents there as they moved fuel and equipment.

"One of our drivers was killed. We brought his body back to Jalalabad," Habibullah said. "His wife came and grabbed me by my collar, tearing my shirt and shouting 'you killed my husband'. I had to give her some money. The Americans don't help with that."

Another driver, Lalajan, sits on a crimson carpet in a container filled with the rattle of an ageing fan against the oppressive heat and says Taliban raids are mounting this summer, as foreign combat troops look to leave the country by 2014.

The NATO-led coalition this week acknowledged that insurgent attacks had risen 11 percent in the past three months compared to last year, with a spokesman blaming a severe winter and crop failures driving poor farmers into paid Taliban ranks.

"We have between us lost 15 trucks this year so far. We had one truck break down and we sent others to help. Then out of the blue the Taliban appeared," said Lalajan, his heavily bearded face furrowing as he sits cross legged with his 4-year-old son crawling over his lap.

"I asked them, I will give you money not to attack my trucks, but they said my money was haram (forbidden). The leader burned them," he said.

No less disruptive are the frequent border closures on the Pakistan side, including a seven-month shutdown enforced on NATO traffic last November after 24 Pakistani soldiers were mistakenly killed in a U.S. airstrike.

The main Torkham border crossing only reopened in July, but Lalajan said there was still an immense backlog and some days only a few trucks could pass a border gateway which last year averaged around 160 each day.

POCKETING THE DIFFERENCE

Adding to security fragility, Lalajan said, was that Afghan drivers working from distribution hubs in Afghanistan like Bagram airbase north of Kabul could not obtain insurance, as drivers coming from Pakistan were able to.

Local drivers, except for those working for the largest transport companies, were also forced to rely on brokers who sold on contracts to smaller firms and pocketed the difference, often as much as half the job's entire worth.

For the majority of contracts paid by the military, worth around $8,000 on average, middlemen pocketed $4,000 for doing nothing other than having good connections.

Drivers then received around $300 per month in salary, but pocketed $1,000 extra in danger money for each 10- to 15-day delivery to military bases in the riskiest areas.

"The middlemen often hold our money for sometimes months, investing it in other things. Sometimes when we go to claim, the company has disappeared and we get nothing. The Americans don't care about that," Lalajan said.

Laghman province, which is home to the truckers, is one of Afghanistan's poorest, with 67 percent of people living in poverty and 78 percent underemployment, while seven in 10 people do not get adequate food each day, according to World Bank data.

Asked which road he feared most, 40-year-old driver Mohammad Qayum said the valley route to the most far-flung U.S. base in the northeast, Forward Operating Base Bostick near the Pakistan border in north Kunar, was the most dangerous.

Bostick, in a natural mountain amphitheatre visited by Reuters in June, is a frequent target for Taliban rockets aimed down at the first battalion of the U.S. 12th Infantry Regiment.

"Last year, two of my trucks were attacked going to Kunar. My nephew was inside and was burned to death," said Lalajan, nodding agreement with his friend.

Smaller cooperatives like his with 70 trucks say margins are so tight they cannot make the security payments to protect convoys and which critics say often end up in the hands of the Taliban, helping fund the insurgent war effort.

"For bigger companies that get first-hand contracts, for them it's possible. They can have 60 trucks in a convoy and can pay some money to avoid attack," he said. "But for us there are lots of Taliban groups. Which one would we pay? The attacks have been mounting."

Habibullah said the only thing keeping drivers in jobs vital to the NATO war effort currently were danger bonus payments, but even they were losing their lure as the Taliban intensified their fight and foreign troops wound back their presence.

"We don't have any faith that the government will reach any deal with the Taliban. If they reach a deal, these attacks on us will still continue, because in the eyes of the Taliban we are kaffirs (infidels)," he said.

"We think for drivers like us, as has happened with some translators, foreign borders should be opened to us. We should be allowed to leave Afghanistan."

Ghana to hold funeral for late president August 10

Ghana will hold a state funeral service and burial for late president John Atta Mills on August 10 after his death this week following an illness, the government announced on Friday.

The funeral "will take place in Accra from Wednesday, August 8 to Friday, August 10", a statement said. "The funeral service and burial will be on Friday, August 10. Further details will be announced later."

Mills died on Tuesday, five months ahead of presidential elections in which he was to seek re-election. No official cause was given, but he was said to have been suffering from throat cancer.

His body was expected to lie in state ahead of the burial.

John Dramani Mahama, who had been vice president, was sworn in to serve out the remainder of Mills' term, as dictated by the West African nation's constitution.

Presidential elections are to be held in December in the country seen as a bastion of democracy in the often turbulent region.

Job Seekers: Branding Yourself As A Generalist Doesn't Work ...

It used to be, the further you got in your career, the more you described yourself as a generalist.

You?d brand yourself as a generalist because that?s what you?ve learned your whole career ? that being a generalist was valuable, demonstrating your ability to quickly adapt to new situations and learn new skills.

The generalist idea

We all learned that it was a badge of honor being able to describe ourselves as a generalists, signifying we had experience in many industries and many job functions.. It was kind of like you had fought in many wars?

This is why so many of us still brand ourselves as generalists. It shouldn?t surprise you that the older we are, the more likely we are to cling to the tradition of generalist branding. Also, many of us just don?t know another way or can?t picture ourselves as anything other than a generalist.

For many years, this worked and worked well. From the 1940?s until 2007, we had a candidate and skills shortage, so employers had difficulty finding managers and workers with the right basic skills ? finding a subject matter expert was rare.

In addition, during the last 17 years, we?ve transitioned to a search based economy ? Now if we want something, we just Google it. A searched based economy allows employers to be specific, more precise in what they want ? and encourages providers (including job seekers) to be more specific and precise in what we can provide.

As marketing guru Seth Godin blogged:

?When choice is limited, I want a generalist. When selection is difficult, a jack of all trades is just fine. But whenever possible, please bring me a brilliant specialist.?

Seth?s right ? why would employers settle for a generalist with shallow knowledge of many things, when they can find a subject matter expert with deep knowledge in solving their specific problem?

Generalist and the expert

When I?ve written about the death of generalist branding in the past I?ve gotten interesting responses. Basically, there?s been an outcry of responses from candidates, generally older workers, who spend much effort describing what businesses should do differently and arguing that businesses should hire generalists. Rather than change themselves, instead these job seekers argue that industry trends should change. Even if it?s true that industry trends are flawed, tilting against windmills won?t help these folks find a job.

Even small companies who are more likely to need generalists and who have truly generalist positions, still hire subject matter experts, not generalists.

While small companies may need people who can wear many hats for certain staff and managerial roles, small business hiring managers typically have one or two overriding priority problems. They typically hire a subject matter expert in solving their priority problems ? who is also able to fill a number of roles and adapt to new situations.

And that?s the order of how companies hiring generalist positions usually make hiring decisions. First ? Find a subject matter expert who has already solved the most pressing priority problems the hiring manager faces. This is almost always done via Applicant Tracking Systems and HR pre-screening. Next ? choose the subject matter expert who also has other skills and the ability to adapt to many roles. The decision of which subject matter expert is also the best at a generalist role is nearly always made during the interview.

If employers first look for subject matter expertise and look via your resume ? why would you brand yourself as a generalist?

US report says Iraq 'rebuilders' died by hundreds

(AP) ? In the first tally of its kind, a federal investigative agency has calculated that at least 719 people, nearly half of them Americans, were killed working on projects to rebuild Iraq following the U.S. invasion in 2003.

The toll represents an aspect of the Iraq war that is rarely brought to public attention, overshadowed by the much higher number killed in combat as well as the billions of taxpayer dollars squandered on reconstruction.

There is no confirmed total number of Iraq war deaths. The U.S. military lost 4,488 in Iraq, and its allies a little over 300. The number of Iraq deaths has not been established but is thought to exceed 100,000.

Navy Cmdr. Duane G. Wolfe was among the 719. He was not fighting the insurgency, but it was fighting him.

He was among the army of lawyers, engineers, contractors and others who paid a heavy price trying to put a broken Iraq and its shattered economy back together. Their deaths were recorded among the war's combat fatalities, but until now no one has carved out the "rebuilder" deaths as a subset of the overall casualty list.

Wolfe was killed on May 25, 2009, in a roadside bombing while returning to Baghdad after inspecting a waste water treatment plant under construction near Fallujah in Iraq's western province of Anbar. The $100 million project endured long delays and large cost overruns, and a U.S. federal audit last fall concluded that it probably was not worth the cost. The audit said "many" people died getting it built, but it did not say how many.

The 54-year-old Wolfe, a Navy reservist, was running the Army Corps of Engineers' office in Anbar at the time of his death; in civilian life he worked at Vandenberg Air Force Base, Calif. Two other U.S. civilians ? Terry Barnich, 56, of the State Department, and Maged Hussein, 43, of the Army Corps ? died in the same bombing.

Wolfe's wife, Cindi, said in a telephone interview last week that he knew the dangers of working in Iraq but made a point of not talking about security or any close calls that he might have had in violent Anbar province.

"He was careful not to worry us with information like that," she said.

The actual number of people killed doing reconstruction work is probably much higher than 719 but cannot be reliably determined, the Office of the Special Inspector General for Iraq Reconstruction said in releasing its estimate Friday. The U.S. government has no central database for this category of war casualties, and even within the U.S. military, the records on hundreds of troop deaths are too imprecise to categorize, the report said.

"We know our number is understated," Glenn D. Furbish, the deputy inspector general for Iraq reconstruction, said in an interview.

Sen. Susan Collins, R-Maine, called the report a "reminder that attempting to build roads, schools and other infrastructure in the middle of a war zone not only carries with it an increased frequency of fraud and waste, but also a devastating price in human life."

The 719 include U.S. government civilians, private contractors, military members, Iraqi civilian workers and third-country nationals. They were trainers, inspectors, auditors, advisers, interpreters and others whose mission was directly tied to the largely ad hoc reconstruction effort that began early in the war. They helped restore Iraq's dilapidated electrical grid, improve its oil infrastructure, develop a justice system, modernize a banking system, set up town councils and reopen hospitals, training centers and schools.

They also helped recruit and train Iraqi police, and they advised the Iraqi army. These trainers and advisers, mostly U.S. military members,- were considered part of the reconstruction effort if their mission was development of the Iraqi security forces, which had been disbanded by the U.S. occupation authorities in May 2003.

None of the 719 was named in the report, but some of the Americans have been recognized publicly by the government.

Among U.S. adviser casualties was Master Sgt. Anthony Davis, 43, who was shot to death Nov. 25, 2008, by an Iraqi soldier while delivering relief supplies. The shooter was in the battalion that Davis was advising as part of a military transition team. Davis's team also assessed schools' needs and planned renovations and organized deliveries. The special inspector general's report did not calculate how many U.S. troops were victims of insider attacks, a problem that has drawn wider attention in Afghanistan in recent months.

Insurgent attacks posed one of the biggest, and least anticipated, obstacles to the reconstruction effort in Iraq, which cost American taxpayers about $62 billion. Sabotage, waste and fraud took their own toll. The human cost, however, was far greater than foreseen when the invaders swiftly toppled Saddam Hussein.

"A completely exact calculation is not possible," the report said, One reason is that the U.S. military's reports on 1,009 casualties were so thin on detail that the type of mission could not be determined. As a result, the investigators could not count any of those in the reconstruction death total.

The 719 killed include 318 Americans, of which 264 were military members and 54 were civilians. The total also includes an estimated 271 Iraqi civilians and 111 third-country nationals, as well as 19 people of unknown nationality. The figures were compiled by combing through a range of documents, including classified data on roadside bomb attacks, according to Craig A. Collier, who directed the project as a senior adviser to the special inspector general for Iraq reconstruction.

Although the 719 killed represent a relatively small percentage of total war deaths, it far exceeds the 172 U.S. and coalition troops killed in the initial invasion, before President George W. Bush's declaration on May 1, 2003, that combat operations had ended. At that point it was mistakenly thought that the war was largely over.

Another of the 719 was Paul Converse, who died March 24, 2008 of wounds suffered in a rocket attack on the heavily protected International Zone in Baghdad that housed the U.S. Embassy and some Iraqi government offices. Converse, 56, was an auditor with the same office that did the death tally released Friday.

To no surprise, Seahawks running back Marshawn Lynch has pleaded not guilty to DUI charges in Oakland, California.? To even less surprise, his lawyer believes that it?s going to take time to resolve the case.

?We will prove that Marshawn was not under the influence when he was pulled over on the evening in question,? lawyer Ivan Golde said, via the San Francisco Chronicle.? ?There is much investigation that needs to be done in this case in that there are many questions about what occurred that are unanswered at this time.? It is going to take some time to unravel everything and, when we do, I am very confident that Marshawn will be exonerated?completely.?

Regardless of whether such an extensive and detailed investigation is needed in order to determine whether Lynch?s blood-alcohol concentration equaled or exceeded the legal limit of 0.08 percent, a delayed resolution ensures that Lynch can?t be suspended in 2012, because he can?t be suspended until the case is resolved.

Even then, Lynch may not be suspended, despite a prior history of two off-field incidents.? As we?ve previously explained, DUIs fall under the substance-abuse policy, not the personal-conduct policy.? For a first-offense DUI (and Lynch is a first-time DUI offender), the penalty ordinarily is a fine in the amount of two game checks.

That said, if Lynch?s camp is confident there won?t be a suspension, he?d be wise to take his alcohol-free medicine in 2012, not 2013.? With a base salary of $4 million this year and $7 million next year, the two-game-check fine would cost $352,941.17 more next year than it would cost this year.

(That said, the Seahawks can always renegotiate his deal and slash his base salary, a fairly easy way to reduce the impact of fines tied to game checks.)

Regardless, even though Golde has created the impression that he wants to move quickly by moving the arraignment from August 15 to Thursday, look for Golde to deftly tap the breaks whenever and however he can.

LG has released its earnings statement for the Q2 2012 period, the claim of "turning a corner" in Q1 has just managed to hold up as it registered net profits of $138 million, up 46 percent from the same period last year. Revenues, while higher than Q1, were actually down from last year and blamed on declines in featurephone sales and slow sales of IT products. The mobile division also struggled after a strong Q1 and took an operating loss, however the positive takeaways are a rising percentage of smartphone shipments and plans to launch new LTE-connected models in North America (we've spotted the likely Spectrum 2 for Verizon already), Europe and Asia later this year. The good news for the home theater segment continued however, with an operating profit of more than double last year at $187.5 million despite slightly lower sales due to an increase in sales of premium products like its Cinema 3D HDTVs, which it expects to become the "top global seller" in the 3D segment. Aging AIDS epidemic raises new health questions

(AP) ? AIDS is graying: By the end of the decade, the government estimates, more than half of Americans living with HIV will be over 50. Even in developing countries, more people with the AIDS virus are surviving to middle age and beyond.

That's good news ? but it's also a challenge. There's growing evidence that people who have spent decades battling the virus may be aging prematurely. At the International AIDS Conference this week, numerous studies are examining how heart disease, thinning bones and a list of other health problems typically seen in the senior years seem to hit many people with HIV when they're only in their 50s.

"I'm 54, but I feel older," said Carolyn Massey of Laurel, Md., who has lived with HIV for nearly 20 years.

"When I hear young people talk about, 'Well you get HIV and you take your drugs and you'll be all right' ? that's just not the truth," she said. "This is a lifelong thing we're talking about, and it unfolds every day on you."

The graying isn't just because people like Massey are surviving longer. Some of it comes from older adults being newly diagnosed, a trend U.S. health officials say is small but slowly growing. Yes, grandparents still have sex ? and that's an age group missed by all those hip safe-sex messages aimed at teens and 20-somethings.

"They let down their guard," is how Dr. Kevin Fenton of the Centers for Disease Control and Prevention puts it.

Already, a third of the nearly 1.2 million people living with HIV in the U.S. are over 50, and by 2020 half will be, Fenton said at one of numerous sessions on aging at the world's largest AIDS meeting.

People 50 or older accounted for 17 percent of new HIV diagnoses in 2009, according to the CDC's latest data. That's up from 13 percent in 2001.

There aren't as good counts in poor regions of the world, where access to life-saving medications came years later than in developed countries.

But even in hard-hit sub-Saharan Africa, home to most of world's HIV-infected population, studies suggest 3 million people living with HIV are 50-plus, said Dr. Joel Negin of the University of Sydney in Australia. By 2040, he said, that could reach 9 million.

There, challenges are different. Ruth Waryaro of Kenya, addressing the conference on her 65th birthday, said clinic workers hassle her when she goes to pick up her monthly supply of medication ? not believing a grandmother really needs it.

"If you're not strong enough, you just leave the medication and go home," said Waryaro, who raised four children of her own and now is raising four AIDS orphans. She also has diabetes and high blood pressure.

As Negin pointedly told the conference, "50 is not old." But for years, world health authorities didn't even measure HIV in people beyond age 49.

Today, people who are diagnosed and treated early can expect a near-normal life-span, Dr. Anthony Fauci, infectious disease chief at the National Institutes of Health, told The Associated Press.

The new focus is on what these pioneering survivors can expect as they reach their 50s, 60s and beyond. They're now getting chronic illnesses such as heart disease, diabetes, kidney disease and osteoporosis ? some of the common ailments when anyone gets old. But studies suggest people with HIV may be at higher risk for some of those illnesses, or get them earlier than usual.

"It's almost created a new subspecialty of medicine," Fauci said.

Perhaps the strongest evidence links HIV and an increased risk of heart disease. Some AIDS medications raise that risk. But in research published for the AIDS meeting, scientists at Massachusetts General Hospital uncovered another reason.

They scanned the arteries of people with and without HIV, and found the HIV patients had more inflammation inside their arteries, putting them at risk for the kind of clots that trigger heart attacks. That's even though the HIV patients had their virus well-controlled and weren't that old ? their average age was 52, the researchers reported in the Journal of the American Medical Association.

HIV triggers body-wide inflammation as a person's immune system tries to fight the virus, a process that persists and can quietly damage organs even with good medications, CDC's Fenton said.

HIV is not acting in a vacuum, said Dr. Amy Justice of Yale University, noting that people's histories of smoking, for example, also contribute to inflammation.

But she pointed to data from a Veterans Affairs study that said older people with HIV use more medications for other diseases than HIV-free patients the same age.

At the conference, some older people with HIV lined up to have their photographs made and their personal histories recorded, part of a Web project called "The Graying of AIDS."

It's a chance to be counted, and share knowledge.

"We're so concerned about the youth factor, we forget about the people who've brought us thus far," said Massey, the Maryland woman, who leads an HIV group called Older Women Embracing Life and works with churches to raise HIV awareness.

CDC's Fenton noted that those voices can help other older adults realize they're at risk, when they're getting back onto the dating scene after years of monogamous relationships. Older people don't use condoms as much as younger people.

"We still have this huge issue with stigma so thick you can cut it with a knife," says Massey, who also wants HIV testing to become a routine part of health check-ups. "We have to normalize the conversation."

Climate change linked to ozone loss: May result in more skin cancer

ScienceDaily (July 26, 2012) ? For decades, scientists have known that the effects of global climate change could have a potentially devastating impact across the globe, but Harvard researchers say there is now evidence that it may also have a dramatic impact on public health.

As reported in a paper published in the July 27 issue of Science, a team of researchers led by James G. Anderson, the Philip S. Weld Professor of Atmospheric Chemistry, are warning that a newly-discovered connection between climate change and depletion of the ozone layer over the U.S. could allow more damaging ultraviolet (UV) radiation to reach the Earth's surface, leading to increased incidence of skin cancer.

In the system described by Anderson and his team, water vapor injected into the stratosphere by powerful thunderstorms converts stable forms of chlorine and bromine into free radicals capable of transforming ozone molecules into oxygen. Recent studies have suggested that the number and intensity of such storms are linked to climate changes, Anderson said, which could in turn lead to increased ozone loss and greater levels of harmful UV radiation reaching the Earth's surface, and potentially higher rates of skin cancer.

"If you were to ask me where this fits into the spectrum of things I worry about, right now it's at the top of the list," Anderson said. "What this research does is connect, for the first time, climate change with ozone depletion, and ozone loss is directly tied to increases in skin cancer incidence, because more ultraviolet radiation is penetrating the atmosphere."

Unfortunately, Anderson said, we don't know how this process will evolve over time.

"We don't know what the development of this has been -- we don't have measurements of this deep convective injection of water into the stratosphere that go back in time," Anderson said.

"But the best guide for the evolution of this is to look at the research that connects climate change with severe storm intensity and frequency, and it's clear that there is a developing scientific case that the addition of carbon dioxide to the atmosphere is increasing climate change, and in turn driving severe storm intensity and frequency."

While it's impossible to know how many skin cancer cases may be related to ozone depletion over the U.S., the link between ozone loss and increased incidence of the disease has been extensively studied, Anderson said.

"There has been a major effort by the medical community to define the relationship between decreases in ozone and the subsequent increases in skin cancer," he said. "The answer is quite clear -- if you multiply the fractional decrease in ozone protection by about three, you get the increase in skin cancer incidence. There are 1 million new skin cancer cases in the U.S. annually -- it's the most common form of cancer, and it's one that's increasing in spite of all the medical research devoted to it."

But it isn't only humans who have to worry about the effects of increased UV radiation.

Many crops, particularly staple crops grown for human consumption -- such as wheat, soybeans and corn -- could suffer damage to their DNA, Anderson said.

Ironically, Anderson said, the discovery that climate change might be driving ozone loss happened virtually by accident.

Though they had worked since the mid-1980s to investigate ozone depletion in the Arctic and Antarctic, by the early-2000s, Anderson's team had turned their attention to climate studies. In particular, they were working to understand how the convective clouds -- updrafts that cause storms to build high into the sky -- contribute to the creation of cirrus clouds.

"It was in the process of looking at that mechanism that we came to this unexpected observation -- that the convective clouds in these storm systems over the U.S. are reaching far deeper into the stratosphere that we ever expected," Anderson said.

While earlier tests performed in the Arctic had demonstrated that water vapor was a key component in creating the "free-radical" compounds that break down ozone, Anderson said the latest finding is much more troubling, because it suggests the process can happen at much higher temperatures than initially suspected.

"The bottom line is that if you increase the water vapor concentration, you actually increase the threshold temperature for executing this chemical conversion -- from the stable forms of chlorine to the free radical form," Anderson said. "If the amount of water vapor and the temperature over the U.S. satisfies the conditions for rapid conversion of inorganic chlorine to this free-radical form, we've got a real problem, because the chemistry is identical to what we previously demonstrated is taking place over the Arctic."

Also surprising, he added, was the realization that, to throw water vapor high into the atmosphere, storms needn't be unusually large.

"We have hundreds of measurements world-wide addressing the photochemical structure controlling ozone, but only a limited number of flights over the U.S. in summer," he said. "The flights were studying average storms over the middle-west, and of the 20 observations we made over the U.S., about half demonstrated significant penetration into the stratosphere," he said.

The next step in the research, Anderson said, is to conduct a series of tests to confirm whether the free-radical form of chlorine and bromine are present in the stratosphere at significantly elevated levels in the presence of convectively-injected water vapor.

"In my mind, this is not just a broad public health issue," Anderson said. "This is about actually being able to step out into the sunlight -- it's about your children and your children's health. Of course, we don't know how rapidly the frequency and intensity of these storms will increase, so we can't place a time scale on this problem, but the core issue here is quite straightforward and simple, because we understand this chemistry."

Colorado massacre suspect appears in court looking dazed, sleepy

CENTENNIAL, Colo. (Reuters) - The man accused of killing 12 people in a shooting rampage at a midnight showing of the new "Batman" film in a Denver suburb made his first court appearance on Monday, looking bleary-eyed and emotionless, his unruly hair dyed shades of orange and red.

James Eagan Holmes, 24, who was arrested outside the theater after the massacre, appeared groggy during the brief hearing, staring straight ahead and occasionally closing his eyes as if fighting off sleep. He was shackled at the wrists and ankles.

About 40 members of the victims' families were seated on the left side of the courtroom. One man seated in the front row of the gallery glared at Holmes throughout the proceedings.

When Arapahoe County District Judge William Sylvester asked Holmes a question, he remained expressionless and his attorney answered for him.

Police say he presented a far different figure last Friday when, dressed in a gas mask and body armor and toting three guns, he opened fire at a packed midnight show of "The Dark Knight Rises" at a theater complex in the Denver suburb of Aurora in the early hours.

The dead include war veterans, an aspiring sportscaster who had narrowly escaped a shooting in a Toronto mall earlier this summer and a 6-year-old girl.

The girlfriend of 24-year-old Alex Teves said he died while saving her life from the gunman in the confusion of the dark movie theater.

"He protected me. My baby didn't hesitate. I was very confused, and he didn't hesitate," a tearful Amanda Lindgren, also 24, told Reuters.

Fifty-eight other people were wounded and many of them have serious injuries.

FRIENDS BAFFLED

Holmes, a former neuroscience student, also left his apartment booby-trapped with explosives that authorities said could have destroyed the apartment complex. They conducted a controlled detonation over the weekend.

Police say they are still searching for a motive for the crime, which baffled fellow students and acquaintances, and have asked for assistance from the FBI's behavioral analysis unit. They described Holmes, a native of San Diego, as a quiet high-achiever whose past gave little inkling that anything was amiss.

At the hearing the judge set a date of next Monday for formal charges to be filed.

Arapahoe County District Attorney Carol Chambers said she would consult with the wounded victims and families of the dead before making a decision on seeking the death penalty.

Chambers, who has prosecuted two of the three inmates now on Colorado's death row, told reporters outside the courthouse that the decision on the death penalty had to be made within 60 days of his arraignment, "so it's months down the line."

The crime meets all the elements of Colorado capital case law, including premeditation, multiple victims, and the killing of a child, said former Denver prosecutor Craig Silverman.

"If James Holmes isn't executed, Colorado may as well throw away its death penalty law," he said.

"I think would be justice," said David Sanchez, whose son-in-law Caleb Medely, 23, was shot in the head while attending the movie with his pregnant wife, Katie Medely, who is Sanchez's daughter. Caleb Medely survived but is in critical condition.

"When it's your own daughter, and she escaped death by mere seconds, it really makes you angry," Sanchez said outside the courthouse. He had come for the hearing but was not able to get into the courtroom.

ATTORNEY: MOTHER'S COMMENT MISCONSTRUED

The judge also issued a protective, or "gag," order in the case that limited what attorneys, law enforcement personnel and court staff could say outside of court.

It was not clear if Holmes' parents or sister attended the hearing, but a lawyer retained by the family, Lisa Damiani, held a press conference to clarify a remark by the suspect's mother to an ABC television reporter soon after the shooting.

Damiani, speaking in San Diego, said that at the time of that early morning phone call, Arlene Holmes was not yet aware of the attack or accusations that her son was involved.

In telling the reporter, "You have the right person," Arlene Holmes was confirming her identity and not referring to her son, the attorney said.

Damiani said Arlene Holmes' comment to ABC had been misconstrued by some media to suggest that she was not surprised to hear that her son had been involved in the shooting rampage.

Damiani also said that the family was "doing as well as they can" under the circumstances but would not be discussing their son or his relationship with the family.

Holmes is in solitary confinement to protect him from other prisoners. He had recently sought to leave a doctoral degree program in neuroscience at the University of Colorado's Anschutz Medical School, a few blocks from his apartment.

University officials said that the campus was evacuated on Monday after two suspicious packages were found, but both were later determined to be harmless.

Barry Shur, dean of the graduate school, said Holmes initiated paperwork to drop out on June 10, three days after completing preliminary exams, a move he called highly unusual.

"Students in this situation are very carefully monitored and coached and counseled," he said. "This does not happen without faculty oversight and, in fact, if any program would be put on a pedestal for that, it would be this one."

Meanwhile "The Dark Knight Rises" took in $160.8 million at U.S. and Canadian box offices over the weekend, which was well below pre-opening estimates of a $170 million to $198 million debut, but still a strong number for the film that box office watchers said felt the impact of Friday's shooting.
